The Punjab and Haryana high court on Friday issued contempt notice to the director and under secretary of the freedom fighters cell of the Union ministry of home affairs (MHA) on a petition claiming non-compliance of the orders on claims of the legal heirs of freedom fighters.

Petitioner Malwinder Jeet Singh Waraich had stated that in April 2012, the court had given orders to liberalise the procedure for considering these claims, particularly in the case of the legal heirs of the freedom fighters whose contributions were well acknowledged and whose names were in the records and history books.

The high court had also directed based on his earlier petition that all legal heirs be brought within the definition of eligible dependents for claiming benefit under the Swantantrata Sainik Samman Pension scheme. The petitioner submitted that he had received a letter in December 2014 from the under secretary of the MHA freedom fighters cell that there was no scope of expanding the family pension scheme to eligible dependents.

He further submitted that the letter violated the high court orders.
