Court orders FIR against hospital for negligence

A Delhi court has directed the police to register an FIR against Fortis Hospital and its management in an alleged case of medical negligence in which a newborn was left disabled.
Metropolitan Magistrate Virender Singh said the allegations against the hospital management and the doctors concerned were “serious in nature” and required probe.
The court was hearing a complaint filed through advocate Sachin Jain, who alleged that on August 12, 2017, doctors at Fortis, Shalimar Bagh, committed “negligence” during the birth of a child.
The complaint alleged the doctors caused grievous injury to the brain of master Devarsh during birth, rendering him disabled, and for concealing the injury from the parents.
“As per the facts of the case, the allegations are serious in nature. Assistance of police is required to collect the evidence. There is also requirement of scientific investigation... The SHO concerned is directed to register FIR under appropriate sections and to investigate the matter thoroughly... The SHO shall file copy of FIR on record within three days after receiving the order,” the court said in its order of September 27.
The complaint had sought registration of an FIR under various sections of Indian Penal Code, including 406 (criminal breach of trust), 420 (cheating), 120-B (criminal conspiracy), 325 (voluntarily causing grievous hurt), 308 (attempt to commit culpable homicide) and 193 (false evidence) against the hospital, its directors and the doctors who performed the operation.
Fortis Hospital said in a statement: “We have not yet received any order in the matter from the Hon’ble court. We find it relevant to highlight that Delhi Medical Council has already examined the allegations made by the complainant in respect of the treatment of her infant at Fortis Hospital, Shalimar Bagh, New Delhi. The Disciplinary Committee of Delhi Medical Council conducted a detailed enquiry and vide its order dated 13.8.2019 concluded no medical negligence can be attributed on the part of the doctors at Fortis Hospital, Shalimar Bagh, New Delhi”.
“We like to reiterate that the patient was treated as per standard medical protocol. Fortis is a responsible healthcare organisation and is committed to the highest standards of patient care.”
