Man accused of raping minor gets 20 years in jail

The Special Judge, POCSO Act Court in Mathura found the accused guilty under section 4 of POCSO Act and sentenced him to rigorous imprisonment of 20 years, with a monetary penalty of 50,000.

Agra ::: Special judge, POCSO Act Court in Mathura Ram Kishore Yadav on Wednesday sentenced a man accused of raping a minor to rigorous imprisonment of 20 years and slapped a monetary penalty of 50,000 on him. The case was registered at Refinery police station of Mathura on November 20, 2019.

Representing the prosecution, special district government counsel (SDGC) Alka Upmanyu informed that the grandfather of the victim (a minor girl) had lodged an FIR, alleging that his granddaughter, aged 12, along with her friend had gone to fetch water from a location near railway station at 3 am.

“The accused Usman alias Naina (35), who lived in the neighbourhood, met the victim and dragged her towards the forest area where he raped her. The incident was revealed by the friend of the victim after returning home. The accused was spotted at the site of the crime but absconded,”” stated the grandfather in his complaint.

‘The case was registered as crime number 337 of 2019 under section 376 (rape) Indian Penal Code and sections 3 and 4 of POCSO Act (Protection of Children against Sexual Offences Act 2012) on November 20, 2019 at Refinery police station against the accused Usman alias Naina who was later arrested,” said Alka Upmanyu .

“The Special Judge, POCSO Act Court in Mathura found the accused guilty under section 4 of POCSO Act and sentenced him to rigorous imprisonment of 20 years, with a monetary penalty of 50,000. In case the accused fails to pay the penalty, he will face added imprisonment of six months and the term he has passed in jail during pendency of case will be adjusted,” said Upmanyu.

“Half of the monetary penalty imposed is to be handed over to the victim,” added Alka Upmanyu .
