District court summons Jaiprakash and Jaypee officials in Noida cheating case

The order came in response to a plea filed by a group of 30 homebuyers, who alleged they were cheated because the promoters failed to deliver flats in Jaypee Wish Town project in Sector 129 of Noida

The Gautam Budh Nagar district sessions court on Monday issued summons to officials of Jaiprakash associate limited (Jal) and Jaypee Infratech Limited (Jil) directors, including Manoj Gaur, Sachin Gaur and Sameer Gaur, in a cheating case. The order came in response to a plea filed by a group of 30 homebuyers, who alleged they were cheated because the promoters failed to deliver flats in Jaypee Wish Town project in Sector 129 of Noida.

“Let the summons be issued under sections 420 and 406 of the Indian Penal Code against Jaiprakash Associate Limited’s Manoj Gaur, Jaypee Infratech Limited’s Suchil Kumar Sharma, Pankaj Gaur, Sachin Gaur and Sameer Gaur. The accused persons should be produced before court on February 22, 2023 for further action,” said additional civil judge Gautam Budh Nagar district.

The petitioners said they had booked flats in Wish Town project’s Jaypee Kasa Isles tower in 2010 with an assurance of delivery within 36 months. But the promoter deliberately did not deliver the flats despite collecting 95% of the payment against their respective flats, the plea said.

“JAL and JIL collected 95% of the flat cost. They diverted the funds to other projects as proved in the investigation conducted by the government and the same has been submitted before the district court. We had to file a plea in the district court in 2016 after Noida’s expressway police station did not register the First Information Report in this case,” said Parimal Tomar, one of the petitioners in the case.

The homebuyers said even after repeated requests and visits, the police did not register an FIR.

“Since 2016 the matter has been on trial and the court has finally issued the summon order. We hope that the district court will deliver justice. The district court has issued summons because we submitted proof that the Jaiprakash Associate Limited and Jaypee Infratech Limited had an intention to cheat as they issued different dates of possession to different buyers in the same tower and diverted the money to other projects,” said Tomar.

JAL and JIL chief advisor Ajit Kumar said, “Our legal department is looking into the matter. Our legal wing is examining the court order.”
