Man files negligence complaint against hospital

The man alleged that he was operated for cancer in Max Superspeciality Hospital, Saket, but did not have the disease. Max Hospital denied the allegations.

Rahul Talwar said that he discovered a swelling on his right thigh in April this year, after which he approached a local hospital in Amritsar, which removed a lump from his thigh and sent it for biopsy to a Mumbai-based lab. The lab, in its report said, it was a cancerous tumour.

In June, he consulted cancer specialists at Max hospital, who asked him to get admitted, and sent the sample for repeat biopsy to the hospital’s laboratory.

The surgery was performed to remove the tumor and the complainant also underwent reconstructive plastic surgery on his right leg.

After both the surgeries, the pathology report of Max Hospital was handed to him that did not confirm cancer.

The complaint was registered on Court’s orders as it amounted to endangering the life of a person by wrong treatment.

In a statement, Max said, “Patient Rahul Talwar had approached Max for the treatment of a cancerous lesion in his right thigh in June. He had with him a confirmatory diagnostic report from a well-known, international chain of diagnostic labs.... the patient had reports of CT and MRI scans done outside Max, which too confirmed the presence of a tumour.”

It added, “In light of the seriousness of the disease in a young patient, Max advised the patient to also take an opinion from the radiation and medical oncology teams at Max Healthcare. Basis these reports, as well as the opinion of the oncology team, it was decided to admit and operate the patient as high grade sarcoma is an aggressive malignancy. The plan of treatment also included Brachytherapy, which involves implanting wires for radio-therapy.”
