"The petition is allowed. The order of trial court is set aside," Justice Suresh Kait said.

The order of the high court came on a petition filed by Singh challenging the special court's order in October, making him an accused in the case and issuing summons against him despite a clean chit given to him by the Crime Branch of Delhi Police.

The trial court had issued summons against Singh, saying there was sufficient material to show that he was part of the alleged criminal conspiracy.

Singh had argued that he was wrongly summoned by the trial court as neither the parliamentary committee nor any of the three charge sheets filed by police portrayed him as an accused.

"Neither any FIR was filed against my client (Singh) nor his name appeared in any of the three charge sheets in the case and even the parliamentary inquiry committee, which had probed the alleged bribery scandal to win MPs' vote, did not name him," Singh's counsel had said.
