CBI charges Talwars with murder, destroying proof

The Central Bureau of Investigation (CBI) has charged Dr Rajesh and Nupur Talwar with murder and destruction of evidence. The CBI court in Ghaziabad was hearing arguments for framing of charges against the dentist couple in the Aarushi Talwar-Hemraj murder case.

The Central Bureau of Investigation (CBI) has charged Dr Rajesh and Nupur Talwar with murder and destruction of evidence. The CBI court in Ghaziabad was hearing arguments for framing of charges against the dentist couple in the Aarushi Talwar-Hemraj murder case.

The agency wants them to be tried under Section 302 (murder) and 201 (destruction of evidence) of the IPC. It has also requested the court to frame additional charges under Section 203 of IPC against Rajesh for lodging false FIR and misleading investigations.

The dentist couple was seen standing together in the witness box. Most of CBI’s arguments were based on its closure report filed in December, 2010. CBI senior public prosecutor RK Saini said the motive of the murder lies in the post-mortem report.

Saini also brought up the “last seen theory” — only four people were inside the flat, of which two were murdered. He went on to say that the couple’s driver had said the number 4 golf stick belonged to Rajesh. “It was cleaner than the other sticks. Its dimension matched those of the injuries on the victims,” he added.

The CBI’s closure report states that the murders took place between midnight and 1am in the intervening night of 15-16 May, 2008.

But Talwars’ counsels argued that their clients were innocent. They also said that the CBI’s theory was based on merely circumstantial evidence and that there was no direct evidence against Talwars. The chain of events was also not linked to each other, they said. The lawyers also added that a mother cannot kill her own child.
CBI Special Judge S Lal has ordered the arguments to continue on Wednesday.
