The Delhi High Court has cautioned all magisterial courts to ascertain vital details of a lawyer before entrusting him the sensitive job of receiving sale proceeds of a disputed property.
Justice Suresh Kait issued the order after coming to know that a lawyer, Sandeep Singh, appointed as 'receiver' by a magisterial court has gone missing after registration of a corruption case against him for allegedly demanding money from the owner of a disputed suit property near Shahdara in East Delhi.
Despite being appointed by the court to help a bank in taking over the property, which had been bought on a loan taken from the bank, the lawyer had demanded the money from the property-owner to thwart its takeover by the bank.
Justice Kait directed the courts of chief metropolitan magistrate and additional chief metropolitan magistrates to ascertain vital details like name, address and telephone numbers, besides his registration number with the relevant bar associations so that he or she could be traced in case of need.
