“Since Kumar continues to stay absconding, we will on Mar 10 request the court to declare him and the other accused proclaimed absconders under section 82 of the Criminal Procedure Code (CrPC),” said an agency source, not authorised to speak to the media.
He added, “Under section 83 of the CrPC, we will also request the court to attach the properties of Sajjan Kumar and the other accused, who were chargesheeted by us.”
The CBI’s proposed requests would not be made against those who might get anticipatory bail from a court, the source added.
The Delhi HC will decide on Kumar’s plea for anticipatory bail on Friday.
Kumar’s lawyer Anil Kumar Sharma rejected CBI’s stand when HT spoke to him. “The CBI is wrong in saying that my client, former MP Sajjan Kumar, is absconding…He is not. He is in the custody of the High Court, where he has applied for an anticipatory bail to protect his liberty and protect himself from getting arrested on baseless charges.”
Sharma added, “For 25 years, no witness or affidavit had mentioned my client’s name and yet the CBI booked him.”
