HC seeks DCPCR report over Shanno Khan's death

The Delhi High Court on Thursday asked Delhi Commission for Protection of Child Rights (DCPCR) to submit before it the report the Commission had prepared on Shanno Khan, the 11 year-old school girl who died to due to alleged corporal punishment by her school teacher last month.

Directing the Commission to furnish the report within three days, Justice G S Sistani fixed the petition, filed by Shanno's father seeking registration of the FIR under stringent provisions of law against the teacher, for hearing on May 25.

Filing a petition, Shanno's father Mohammed Ayub Khan sought the court's direction for registration of the FIR under Section 304-II (culpable homicide not amounting to murder) of the IPC where the maximum sentence is upto 10-year.

So far, the police have registered the case under Section 304 A (causing death by negligent act) of IPC where the maximum punishment is two-year jail.

Appearing for the petitioner, counsel Rohit Kochar submitted before the court that the MCD school teacher should be booked under the relevant provisions of law because she owed a moral responsibility and legal obligation to protect any student.

Manju, the accused school teacher who allegedly asked the girl to stand in the sun, was suspended by the authorities.

The Court on Thursday issued fresh notice to the teacher as it was not served earlier due to change of address.
