Earlier submitting the closure report with Additional Chief Metropolitan Magistrate Rakesh Pandit, the investigating agency had said that Tytler was not present at the site of the incident.

HS Phoolka, counsel for Delhi Sikh Gurudwara Management Committee, had vehemently opposed the final report filed by the CBI.

“The CBI has manipulated the investigations to protect Jagdish Tytler from criminal proceedings and even provided him a copy before it could be produced in the court,” Phoolka submitted in the court.

He had also objected the CBI's contention stating that the current case should be transferred to a session court, as the case involves Section 302 of the Indian Penal Code.

Responding to victims counsel's objection, the court had fixed April 28 and 29 for arguments on the closure report filed by the CBI.
