High Court seeks NDMC response on law violation

The Delhi High Court on Wednesday sought an affidavit from the New Delhi Municipal Council (NDMC) about its sanction for construction of extra floors in some premises in posh Jor Bagh area in south Delhi on an allegation that the council had violated the Delhi Master Plan, 2021.

A division bench of chief justice Dipak Misra and justice Sanjiv Khanna asked the NDMC counsel to file an affidavit with details about its sanction to eight premises for extension of floors.

The bench was hearing a PIL accusing the council of violating the building bylaws and Delhi Master Plan while allowing some builders to construction the houses.

The petitioner, a resident of the area, said that in 2007 the Supreme Court had permitted the construction of extra floors subject to certain conditions and in compliance with the Masterplan.

According to the petitioner, for every 100 square metre of built-up area parking for one car should be provided and on a plot area of 75 square yard parking space for 10 cars should be provided to the residents. However, in violation of all the norms of the masterplan and building byelaws, NDMC has granted sanction for the huge benefit of some builders.
