Ever heard of a judge going an extra mile in pursuit of evidence even after the person charged with it says he is guilty?
This is what happened in a drink driving case in Patiala House Courts.
Metropolitan Magistrate Devender Jangala was forced to take the unusual step, as according to the rules, he could not punish accused Puneet Khurana without any medical evidence against him.
And this eluded the court, as the Medical Officer of AIIMS, where Khurana was taken after his arrest during the drink driving crackdown on Republic Day, did not give a report to police.
The Magistrate has now summoned AIIMS Chief Medical Officer and the Medical Officer who conducted the test on Khurana to, and asked him to appear in the court with the document on Wednesday.
The Investigating Officer (IO) informed the court that he had taken the accused to the hospital for his medical exam. Moreover, the accused said he was not provided even a copy of his medical exam.
Khurana was intercepted at Malviya Nagar while he driving a Honda City car. The police immediately took Khurana to J.P.N Trauma Centre, AIIMS hospital, to take his blood sample to identify the consumption and percentage of alcohol. On Monday Khurana was produced in the court, and requested the court for a soft look at his offence. But to his surprise, the judge found no mention of alcohol percentage in the medical report.
