But after the guilty verdict, Babbu went home as a free man as he had already served most of his sentence during the trial.
“Babbu has spent one week in custody before being released on bail. The court finds it imprudent to commit him to imprisonment,” said Metropolitan Magistrate Vishal Gogne after sparing him an additional jail term.
While setting off the convict's sentence against his one-week incarceration already undergone by him after his arrest in 2004, the judge also imposed a fine of R1,000 on Babbu.
On December 17, 2004 Babbu was found in possession of four obscene books at a bus stand in Pandav Nagar area of East Delhi.
The accused had initially pleaded not guilty but after the court granted him time to reflect on his plea, Babbu himself pleaded guilty after framing of charges against him.
The court also noted that the accused had already faced a trial for eight years for possession of only four books containing the objectionable content and is also advanced in age.
