The discom contended it was facing a financial crisis because of the pending litigation.

The bench was hearing a PIL that accused the government of succumbing to pressure from discoms and directing the DERC not to issue a new tariff order approved by it for 2010-11, which it claimed was lower than the present rates.

Earlier, the bench had rapped the city government and the Commission for their ongoing tussle over fixing of new power tariff for the Capital. The bench issued a notice to the petitioner for a response by January 21.
