Section 304A
According to this section anyone who causes any person's death by any rash or negligent act — not amounting to culpable homicide — will be punished with jail term that might extend to two years or will be fined, or be punished with both.
The offence under this section is bailable and non-compoundable.
This is the reason why Aggarwal secured bail in the case. Though the police are waiting for the post mortem report and forensic reports before giving him a clean chit.

Why the mild charge
According to the police, all evidence in the case point towards the possibility that it was Wilson who allegedly started the argument with the accused and then started hitting him. The police believe that the deceased was killed when the accused was trying to escape and sped his vehicle that Wilson held on to.
Not leaving anything to chance, the police have questioned eyewitnesses and also filmed their statements.
“We booked the accused under these sections only after we spoke to a number of eyewitnesses. According to their statements and our investigations the deceased got into a fight with the accused. Aggarwal was trying to escape from the spot but as Wilson was holding on to the car the accident took place. Still we are waiting for FSL and post-mortem report in the case," said Dharmender Kumar, joint commissioner of police (New Delhi range).
The police said that they would impose additional charges on Aggarwal if the output of their investigation and forensic and post mortem reports indicate any foul play in the matter.
And if the reports come in favour of Aggarwal they would file the charge sheet on the current charges only.

That is what friends and family members of deceased Rajeev Jolly Wilson feel.

The family said that no one came forward to help Wilson when he was writhing in pain. They said the incident happened at 1.40pm in front of several people, but all they have to give are different versions of a story.

“It happened in plain sight of hundreds of people. The crème de la crème of the city visit the area, but no one has anything concrete to say other than giving out their versions of the incident,” said Sunil Saliyan, a close friend of the deceased.

The restaurant, Amici, where the deceased worked will remain closed for two days and the staff will going to mourn. They said they will give their full support to Wilson’s family.

The 41-year-old was allegedly run over by a Jet Airways pilot, Vikas Aggarwal, on Tuesday afternoon after they fought over a scratched car.

The two got into a quarrel after Aggarwal allegedly nicked Wilson’s car. According to the police, Wilson thrashed Aggarwal, following which the accused tried to escape and accidentally ran over Wilson.
