The Supreme Court on Friday allowed construction of third floor in the residential colonies in the national capital subject to the undertaking given by the owners to abide by its final decision on the validity of the master plan for Delhi (MPD) 2021.

The apex court said neither the owner nor the person to whom the property would be sold or transfered could claim equity, if verdict goes against them.
The construction would be permitted in terms of the MPD 2021 but where it has been allowed to have six dwelling units in a plot, it will now have five.
Similarly, in the plot, where the permitted dwellings unit is nine, it will be not more then seven and in category where the maximum sanction dwelling unit is ten, it will not exceed more then eight.
In no case, the number of dwellings unit will exceed ten, and the construction of the third floor should be in conformity with the specified height and floor area ratio stipulated in the MPD 2021.
