SC says Talwars are adopting dilatory tactics

The Supreme Court on Tuesday rejected dentist couple Rajesh and Nupur Talwar’s plea to direct the CBI to produce reports of polygraph, narco-analysis and brain-mapping test conducted on their three employees before the trial court as evidence.

After going through the facts placed by the CBI in response to the Talwars’ plea, a bench of justice BS Chauhan and justice SA Bobde observed that the couple had been adopting dilatory tactics to delay the trial involving them. Their present appeal before the Supreme Court, too, was part of the same tactic, the court said.

“Thus, from the afore-stated facts, it is evident that the petitioners have been adopting dilatory tactics at every moment,” the bench said. It added that the order under challenge by the Talwars before the SC was passed two months ago.

“In view of the above, we are of the opinion that facts and circumstances of the case do not warrant any interference. The special leave petition is accordingly dismissed,” the court said.

The employees — Raj Kumar, Vijay Mandal and Krishna — were named as accused by the first CBI team in the murder of Talwars’ teenaged daughter Aarushi and their domestic help Hemraj. However, the second CBI team gave a clean chit to the three. It even filed a closure report against the Talwars, saying there wasn’t enough evidence to prosecute them.

A magistrate court, however, rejected the closure report and summoned the couple to face trial.

Opposing the Talwars’ petition, the CBI said the application was made with an intention to delay the proceedings which are at a concluding stage. It was contended that the trial court judge was scheduled to retire by November end and the dentist couple’s petition was an attempt to prolong the pronouncement of the judgment.

Both prosecution and defence evidence before the special CBI court in Ghaziabad is over. The final arguments are yet to be concluded.
