Student moves HC against denial of nursery admission

The Delhi high court on Friday sought a response from the city government and six private schools on a plea for quashing of draw of lots conducted for admission in nursery class for economic weaker section children (EWS) on the ground that they violated the Right To Education Act.

The court, however, asked the Directorate of Education to probe the allegation of Kanishka Panwar, a minor, who approached the court through his mother Kavita, alleging the schools have denied him admission as his father's annual salary is R1.4 lakh whereas the schools fixed it to the limit of R1 lakh to claim quota under EWS category.

Justice Rajiv Sahai Endlaw issued the notice to the Education Department and the schools and sought their replies by March 11 on Kanishka's petition alleging denial of admission in nursery class under 25% quota for EWS children is violative of the RTE Act.

The court also directed the Education Department to submit a report after conducting an inquiry by March 11, the next date of hearing.

According to him, the annual income of their parent is Rs 1,44,000 and the amount did not dis-entitle him to be considered for admission under disadvantaged group.

The petitioner's counsel submitted the parents had made a representation against the schools but no action has been taken by the government so far.
