Secretary of the managing committee Hafiz Badruddin, Rais Ahmad Khan, Qausar Ali, Saif and Naushad said if within two weeks the illegal construction was not demolished, the committee members would take further action. They said the cemetery was situated in the heart of the city and members of a particular caste had made it a gambling den in connivance with the local police. They demanded to check entrance of unsocial elements in the cemetery.

Responding to a question, Mohd Aslam and Aftab Alam said during her visit on September 8, 2005, then chief secretary Nira Yadav had directed demolition of the encroachment and to increase the level of the land by dumping soil.
