Passing this order, a Division Bench, comprising Justice Sunil Ambwani and Justice Dilip Gupta, observed: “We had passed a detailed order on March 11, 2005 that these hospitals shall be made fee from rostering, scheduled rostering and power cuts. This was made applicable to other public hospitals in the State, run and managed by the Government. Later, an application was moved by the UP Power Corporation that three hospitals in Allahabad had been given independent feeders and there was continuous supply to these hospitals, but making all the government hospitals free from rostering is a gigantic task involving a huge amount of money. We did not modify our order, but when the second application was moved, we reluctantly modified the order to the extent that the Government Hospitals in the State will not be subjected to any rostering from 8 am to 3 pm. We also ordered that at the same time, the Power Corporation must take steps for setting up of independent feeder line for each government hospital in the State so that they may be supplied power uninterruptedly.”
During the hearing, the counsels appearing for UP Power Corporation, WH Khan and Anil Mehrotra, stated that they shall ensure that the order passed by the court was duly complied with and three hospitals were not subjected to any rostering.
Regarding the setting up of a sub-station in Moti Lal Nehru Medical College, Allahabad, advocate-general SMA Kazmi said he would convene a meeting in which the medical college principal, the counsel representing the Power Corporation and officers of the Power Corporation will participate.
On this, the court observed, “We have no reason to doubt that the Advocate-General will use his good offices and impress upon these authorities to arrive at a solution so that the setting up of a sub-station is not delayed any further.”
Besides, the court directed the municipal commissioner to ensure removal of encroachments from the approach road. For this purpose the SSP, Allahabad, shall render all such assistance as required.
The court passed this order on a writ petition filed by Satish Chaturvedi.
