The matter came up before Judge Abhay Thipsay who decided to hear it in the month end as prosecutor Jimmy Madon sought time to file his reply to Ashwin's bail plea.

Ashwin was brought to the court on a wheel chair as he has been paralysed following a murderous attack on him by rival gangsters.

Prosecution has alleged that Neeta, a city corporator, was murdered in 2000 on instructions from Ashwin as he suspected her of taking control of his gang's activities.

Ashwin, lodged then in Tihar jail, had plotted the murder of Neeta and asked his men to shoot her, prosecution has alleged.

In several cases Ashwin has been acquitted but in Neeta Naik case he is still facing the trial while three accused have been convicted while two others acquitted.
