HC rejects plea on over-age

THE ALLAHABAD High Court has dismissed a writ petition, seeking permission to over-aged candidates to take the State Judicial Services Examination 2006, better known as PCS (J) examination. These candidates became over-aged due to non-declaration of vacancies for two consecutive years. The maximum age limit for the general candidates in this examination is 35 years.

THE ALLAHABAD High Court has dismissed a writ petition, seeking permission to over-aged candidates to take the State Judicial Services Examination 2006, better known as PCS (J) examination.

These candidates became over-aged due to non-declaration of vacancies for two consecutive years. The maximum age limit for the general candidates in this examination is 35 years.

A Division Bench comprising Justice Sushil Harkauli and Justice Pankaj Mithal while dismissing a writ petition filed by Neeraj Kumar and several others gave the verdict.

Counsel for the petitioners, Rakesh Pandey argued that as per rules if the vacancies were not announced in one year, the candidates becoming over aged in that year would be accommodated whenever the vacancies were advertised.

In view of this, he argued that the last examination of the State Judicial Services was held in 2003. Thereafter, the present examination is going to be held in 2006, after a gap of two years. Therefore, those who had become over-aged during this period due to non-declaration of vacancies, should also be permitted to take the examination.

Lawyers demand age relaxation

A LARGE NUMBER of lawyers, seeking age relaxation in the State Judicial Services examination 2006, blocked traffic outside the high court on Kanpur Road on Thursday.

The agitators, under the leadership of Jitendra Naik, president of UP Nyayik Sewa Pratiyogi Morcha, said they could not take the examination from 1999 to 2000 as three years’ experience of legal practice was required.

Thereafter, they took the examination only in 2003. Now, after a gap of two years, the vacancies were announced in 2006. However, they could not take the examination as they have crossed the upper age limit during the two years period.

They alleged that as per notification issued by the UP Public Service Commission, a candidate would be given four chances to take the examination.

Therefore, they were to make three more attempts, Naik said. Naik urged all the over-aged candidates to assemble in Chandra Shekhar Azad Park on November 3 at 4 pm to chalk out a future course of action.
