HC: remarriage can’t stop compensation

Ruling that remarriage will not deprive a person from claiming compensation for the death of a former spouse, the Delhi High Court (HC) has awarded Rs 3 lakh to a woman whose husband died in a bomb explosion in a DTC bus 18 years ago.

Ruling that remarriage will not deprive a person from claiming compensation for the death of a former spouse, the Delhi High Court (HC) has awarded Rs 3 lakh to a woman whose husband died in a bomb explosion in a DTC bus 18 years ago.

“I hold that remarriage/possibility of remarriage will not deprive a person from compensation for the death of his/her spouse...,” said Justice J.R. Midha in a judgement.

The court rejected the DTC counsel’s arguments that three years after the death of Sansar Pal, his widow married again. She was, therefore, not entitled to compensation.

The court also rejected DTC’s other argument that the accident was not caused by rash and negligent driving and

therefore, the victim deserved no compensation.
