This order was passed by a division bench comprising Justice RP Mishra and Justice RN Mishra on a writ petition filed by Sahara India. The court has also granted three weeks? time to the State government and the Ghaziabad Development Authority for filing the reply.

As per facts of the case, petitioner Sahara India had purchased 91.628 acres of land for Sahara City Home, but now the same is being acquired by the GDA.
Appearing on behalf of the petitioner, Shakti Nigam submitted before the court that acquisition was against the norms of Land Acquisition Act and further it had also not been made clear that who would pay the amount of compensation.
Direction to AU counsel: The HC has directed the counsel for Allahabad University to get instructions on the specific allegations made by petitioner Raghunath Dwivedi, a candidate for the post of president of Allahabad University Students’ Union election, that Ajit Yadav, the president of AUSU, was not eligible to contest the election for the session 2005-2006.
Passing this order, Justice Bharti Sapru directed to put up this case on May 26 for next hearing.
The court passed this order on a writ petition filed by Raghunath Dwivedi, a defeated candidate for the post of president of Allahabad University Students’ Union. Dwivedi has challenged the election of Yadav as president of AUSU on the ground he was not eligible to contest the election for session 2005-2006.
Dwivedi’s plea was that Yadav was already working as a teacher in a government school and he had also withdrawn his migration certificate from the Allahabad University before he contested the polls.
