A Division Bench comprising Justice RS Sodhi and Justice PK Bhasin also issued notices to the accused on an application moved by the prosecution seeking a fresh ballistics examination of the empty cartridges recovered from the scene of offence.

Appearing for the Delhi police, State Counsel Mukta Gupta urged the court to grant permission for referring to a board of forensic experts the empty cartridges for a "fair and just opinion".

She pointed out that the trial judge had acquitted the accused on the ground that the two cartridges recovered from the site originated from two different weapons.
