Faizan had filed an application claiming that he was a minor but the Board in its decision dated July 25 declared him a major and returned the case to ADJ Sushila Singh’s court.

The Board took the decision following report submitted by the medical board.

The medical experts had examined Faizan on July 8 and referred in their report that his right elbow-joint, wrist joint and the ankle joint were found fused. It established that Faizan was around 20-year-old.

Besides, Faizan’s certificate, which shows him a minor, was made from Florence Nightangle. The school reportedly was not recognized in the year when Faizan took the admission. Since the application was found baseless the Juvenile Board turned down the plea.

Faizan had submitted the application on May 19 claiming that he was a minor and that his case should be dealt with at the juvenile court. However, the court said that Faizan and his family were unable to produce the Nagar Nigam birth certificate and the family did not have any other age proof either. The Medical Board report after an examination declared his age to be 20 years. According to the report Faizan was 19 years old when he committed the crime. The board also said that the Medical Board’s report is trustworthy and it is the biggest proof of his age.

It may be recalled that rape victim’s father Sabruddin had filed an application in the District Judge (DJ) a few weeks back challenging the documents filed by a few of the accused in favour of being juvenile. The court had issued notices to the concerned persons then.
