Munshi was arrested at the airport but was given bail on May 13.

His counsel Tamal Mukherjee filed the application in the sub-divisional judicial magistrate court at Barrackpore in the North 24 Pargana district, seeking an order for the return of the passport that is in the custody of the airport police.

He also sought the quashing of the case against Munshi under section 41 of CRPC (arrest on suspicion), claiming that there was no charge against him.

The court directed the airport police station's enquiry officer to submit a complete report.

Munshi, who had turned hostile during the high-profile murder trial, was apprehended by immigration officials at Netaji Subhas Chandra Bose International Airport when he arrived to complete formalities before boarding a Bangkok-bound Indian flight.

He was arrested on the basis of a look out notice issued by Delhi Police.
