“Our judges will decide,” was the CJI’s response when asked by reporters on the CIC’s direction on Wednesday to the Supreme Court registry on the issue.

The information watchdog had asked for the file notings and other communication to be made public, that formed the basis of denial of promotion to three judges, including the Delhi High Court Chief Justice, A.P. Shah, to the Supreme Court last year.

The CJI’s response came on the sidelines of National Law Day celebrations.

Delhi-based Right to Information activist, Subhash Chandra Agrawal had approached the CIC following the SC’s refusal to provide him information on the issue.
