Talwars to be tried for Aarushi murder

A CBI court here on Thursday ordered the framing of murder and destruction of evidence charges against dentist couple Rajesh and Nupur Talwar in the Aarushi and Hemraj double-murder case.
The order ironically came on Aarushi’s birthday.
The court ordered that Rajesh also be charged for misleading the investigation.
The CBI argued that Rajesh filed a misleading FIR on May 16, 2008, putting the blame for the murder of his 14-year-old daughter Aarushi on Hemraj. But the help’s body was found a day later on the terrace of the Talwars’ Jalvayu Vihar apartment in Noida.
The court observed that a case existed prima facie and the evidence put up by the prosecution need not be minutely examined at this stage.
The court fixed Friday for the framing of charges formally after which the trial date would be fixed. The onus of proving the charges would rest on the CBI.
The Talwars’ counsel indicated that their priority now would be to get bail for Nupur, who is lodged at Dasna jail in Ghaziabad since April 30. Rajesh is out on bail.
The counsel had on Wednesday argued that Aarushi and Hemraj were murdered by an outsider, who managed to enter the Talwars’ residence as he knew the help.
A CBI special court had in February 2011 summoned the Talwars as accused under sections 302 (murder), 201 (destruction of evidence) and 34 (common intention) of the IPC.
The magistrate had taken cognisance of the CBI’s December 2010 closure report, which pointed a finger of suspicion at the Talwars.
