This order was passed by a division bench comprising Justice Imtiyaz Murtaza and Justice Amar Saran on a writ petition filed by Raja Prasad Pandey, after hearing counsel for the petitioner senior advocate UN Sharma.
President of Triveni Sheet Glass Workers’ Union, Iradatganj, Ghoorpur, Allahabad Amarendra Kumar Pandey was killed on March 24, 2004 at Ghoorpur, a trans-Yamuna locality of Allahabad.
In the FIR filed by Pandey’s uncle, it was alleged managing director of Triveni Sheet Glass Factory JK Agrawal, chief security advisor KK Gupta and deputy general manager CP Yadav were behind Pandey’s murder. It was alleged they had threatened Pandey and had asked him to keep away from trade union activities. When he did not bow before them, they got him eliminated.
Thereafter, JK Agrawal filed a writ petition seeking stay on his arrest, which was dismissed by a division bench of this court.In this petition seeking a CBI probe, it has been alleged there was no chance of impartial investigation by local police.
Moreover, Agrawal, the main accused, has not been arrested despite the court rejecting his petition.
