The New Jersey Division of Child Protection and Permanency are also trying to conduct the operation without approval from his parents, even though the parents are expected to bear the cost of the child's upkeep and medical treatment.

On September 7, the US authorities had taken away Indrasish from parents Debasish and Pamela Saha, alleging negligence after he sustained head injuries at their New Jersey home. The parents said he had fallen from the bed but the US authorities alleged that the baby was suffering from Shaken Baby Syndrome. The matter is since being heard in a US court.
