Auto driver, two aides held guilty in Chandigarh gangrape, quantum on Friday
Additional district and sessions judge Poonam R Joshi on Monday pronounced three men guilty of raping a 22-year-old woman in Chandigarh on November 17 last year.
The quantum of punishment for the gang rape accused Mohammad Irfan, Mohammad Garib and Kismat Ali will be announced on Friday.
In a case that sent shockwaves through the Chandigarh tricity, charges were framed against the trio under Sections 376d (gang rape) and 506 (punishment for criminal intimidation) of the Indian Penal Code.
Life terms for the accused cannot be ruled out, sources who are not authorised to speak to the media have said on condition of anonymity. A DNA match of the accused and the victim provided concrete proof of their crime.
The victim who belongs to Dehradun boarded an autorickshaw driven by Irfan while returning to her paying guest accommodation in Mohali from stenography classes in Sector 37, Chandigarh. Irfan allegedly took a detour towards Sector 42, saying he had to refuel the vehicle, which also had two male passengers. After refuelling, Irfan drove to an isolated forest area in Sector 53 opposite to Sector 42 where the three men allegedly raped the woman before fleeing. The victim then informed passers-by and they called the police.
The three men were identified by their images captured by CCTV cameras at the Sector 42 petrol pump when the autorickshaw was being refuelled.
Irfan was the first one to be arrested on November 24, a week after the crime was committed. His interrogation led to the arrest of the two other men the next day in Uttar Pradesh.
Investigations in the case earlier this year also revealed that Irfan had raped another woman. The 21-year-old call centre employee had in December 2016 also boarded an autorickshaw driven by him.
She identified Irfan during an identification parade and forensic examination of semen established his involvement in the crime. While recording her statement before the court, the call centre employee alleged that Irfan had tried to gain her confidence by having an emotional conversation about his daughter.
