Man gets 10-year, another 5-yr jail for raping minor

A local court on Friday awarded 10 year and five year jail to a 29-year-old and 22-year-old man respectively for kidnapping and raping a 17-year-old. The court of additional district and sessions judge Anshu Shukla has also imposed a fine of Rs 31, 000 and Rs 11,000 respectively.

A local court on Friday awarded 10 year and five year jail to a 29-year-old and 22-year-old man respectively for kidnapping and raping a 17-year-old. The court of additional district and sessions judge Anshu Shukla has also imposed a fine of Rs 31, 000 and Rs 11,000 respectively.

Lakhwinder, 22, resident of SAS Nagar, who has been sentenced to five year jail, was convicted under Sections 120B, 365 and 342 of the Indian Penal Code (IPC) while Sonu, 29, resident of Panipat, has been given 10 year jail under Sections 120B (punishment for criminal conspiracy), 376 (2) (punishment for rape), 365 (kidnapping or abducting with intent secretly and wrongfully to confine person), 366 (kidnapping, abducting or inducing woman to compel her marriage, etc), (punishment for wrongful confinement) of the Indian Penal Code. Both were also held guilty under sections of the POCSO Act.

The incident dates back to September 2015 when it was complained by the father of the victim that her daughter was missing and probably kidnapped. In the complaint he mentioned that her minor daughter went to Gurdwara to have langar and even after many hours, when she did not return home, he filed a complaint with the police. After few days, police nabbed Lakhwinder and Sonu .

The counsel for the complainant, Pratibha, argued that the medical report of the victim confirmed rape. Further, counsel for Lakhwinder, Lalit Mohan Sharma, stated it was also admitted that Sonu raped the victim and Lakhwinder helped him in kidnapping.

The court has also recommended a compensation to the victim due to the trauma the incident might have caused to her and therefore asked the District Legal Services Authority to look into the same.
