Chargesheet against 'rapist' cops filed

Dismissed Chandigarh Police constables Akshay and Sunil had raped the minor resident of Khuda Lahora, while the three other co-accused - Jagtar Singh, Himmat Singh and Anil - had molested her for months together.

Dismissed Chandigarh Police constables Akshay and Sunil had raped the minor resident of Khuda Lahora, while the three other co-accused - Jagtar Singh, Himmat Singh and Anil - had molested her for months together.


This was stated by the police in the chargesheet filed against five UT police constables - Jagtar Singh (23), Akshay (24), Sunil Kumar (23), Himmat Singh (24) and Anil (25) - arrested on December 19 on the allegations of raping and molesting a minor girl for months.
"The act was always independent and in isolation, but all accused were aware of the act. Thus, they have been charged with conspiracy," claims the chargesheet filed in the court of additional district and sessions judge Najar Singh.

All accused are currently lodged in Burail jail and the case will now come up for hearing on February 28.The chargesheet running into about 100 pages was filed under sections 376g (gangrape), 120 (conspiracy), 341 (wrongful restraint), and 354 (assault or criminal force to woman with intent to outrage her modesty) of the Indian Penal Code along with booking them under the Protection of Children from Sexual Offences Act.

"We are yet to receive a copy of the chargesheet and will be in a position to say anything only after going through the challan," said Gagan Aggarwal, victim's counsel.

BJP councilor Saurabh Joshi, who was instrumental in getting the case lodged, said, "I have learnt that chargesheet has been filed before the court, but the victim's counsel is yet to receive the copy. The police from day one have been non-serious in the case and non-supply of the copy of chargesheet to the victim's counsel speaks volumes. The law provides that the police should help the victim but in this case it is otherwise. I would be seeing UT SSP on this issue, who is at present out of city."


Akshay, Sunil raped me: victim's statement
The chargesheet had statement of the victim in which she had alleged that Sunil and Akshay sexually assaulted her for months. She even claimed that after every sexual assault the accused used to administer her emergency contraceptives. She also accused them of threatening her with their official weapon in case she raised the alarm.
The victim's statement also mentioned that Sunil, who is married, had offered to marry her once the case was registered and even offered her money for compromise.
The victim alleged that accused Jagtar, Himmat and Anil used to follow and molest her.

Akshay admits to 'relations' with victim
Accused Akshay had admitted having relations with the victim and had even said the girl had been visiting his house. Jagtar and Akshay stayed in a rented room near the victim's house.
Akshay had claimed to have met the victim in a market, after which they became friends and the girl allegedly frequented his room.
Explaining as to how she came in contact with Sunil, Akshay had told the police that one day when he was on duty he had sent Sunil to pick her up from school. Sunil had admitted that the "friendship" led to physical relations with the girl on December 8.

Know the accused
Jagtar Singh: Joined Chandigarh Police in May 2010. Was with the crime investigation department (CID) till November 26, and then posted with PCR (ambulance) at Sector 25
Akshay Kumar: Joined force in May 2011, remained in PCR till December 2011. After that, he was in CID, then at Sector-31 police station, before being posted in PCR on November 26
Himmat Singh: Since his joining UT police in May 2011, he has been posted with the PCR
Sunil Kumar: Joined force in May 2011 and remained in CID for about a year before he was appointed in the crime branch.

What the accused face
Gangrape: If convicted, the accused will face a minimum imprisonment of 10 years and maximum life term and would also be liable to fine.

CFSL report still awaited
The chargesheet is accompanied with medical report which confirmed that the girl was subjected to repeated sexual assault. However, the CFSL report is still awaited and will be filed later.
