Tour operator to pay Rs 1.5 lakh compensation, refund Rs 9.5 lakh

Disposing of the petition filed on behalf of Rotary International District 3080, SAS Nagar, the consumer forum also directed Mahindra Holidays and Resorts India Limited, Club Mahindra Travels Division, New Delhi, to refund Rs 9.50 lakh, along with 9% interest, charged in excess by the travel operator for a convention trip to Bangkok.
Rotary International District 3080, had moved the consumer forum, accusing Mahindra Holidays and Resorts India Limited, Club Mahindra Travels Division, New Delhi, of deficient services and unfair trade practices.
Pankaj Chandgothia, convenor of the Rotary Legal Cell, contended that preliminary agreement was signed with tour operator and advance payment was made. He alleged that the tour operators started demanding extra payment on false pretexts such as cancellation charges paid by them to Cathay Pacific airlines, without any proof.
Rotary International District 3080 accused the tour and travel operator of charging Rs 10 lakh. The tour operator had also threatened the complainants that of the said amount was not paid, they would not be allowed to undertake the tour.
Chandgothia alleged the company failed to provide proper services. He alleged that tour operator had charged excess for children tickets, inspite of promising lower rates earlier and instead of 4-star hotels, they provided 2 or 3-star accommodation.
Contesting the complaint, Mahindra Holidays and Resorts India Limited, Club Mahindra Travels Division, New Delhi, submitted that the complaint is a gross abuse of process of law. In its reply, the tour operator submitted that the complainant made delayed payment which caused huge difficulty to operate the tour.
Rotary International District 3080 had hired the services of the said tour and travel operator for attending Rotary International's convention in Bangkok from May 5-9, 2012.
