Holding Om Prakash guilty of the crime, the court observed, "The convict has given the minor girl severe mental trauma, humiliation and an emotional scar for life. The convict does not deserve any leniency in the matter of sentence. He has committed a grave crime, raped a minor girl under the age of 16."

According to prosecution, the incident came to light on September 2, 2010, when Snehalaya manager complained that the 14-year-old inmate was pregnant.

The manager told police that the minor girl had visited her grandmother's house at Bapu Dham Colony in June 2010. After the child's grandmother refused to be complainant in the case, the manager complained after which a case was registered against the accused under Section 376 of IPC.

Omprakash pleaded before the court to take a lenient view as he was poor, has a wife and two children to support. The prosecution on the other hand contended that the offenses under Section 376 of IPC were serious and no leniency should be shown to the accused in such case.
