Himachal HC stays promotion to 790 posts in Kangra coop bank

The high court of Himachal Pradesh has stayed the promotions in Kangra Central Cooperative Bank, Dharamshala, after an employee alleged violation of the Rights of Persons with Disabilities Act.

In an order passed on the petition filed by one Bharat Bhushan, the division bench of chief justice AA Syed and justice Jyotsna Rewal Dua directed the bank authorities that no post should be filled up by the way of promotion without the high court’s permission.
The bench has also sought response from the state government and bank management within three weeks.
Petitioner Bharat Bhushan has alleged that while filling these posts, the bank was violating the provisions of the Rights of Persons with Disabilities Act.
The petitioner is a Grade-2 employee and has been working in the bank since 1999.
Bhushan contended that he belonged to the Scheduled Caste (SC) and was 80% disabled.
He also argued that under the notification issued on July 6, 2022, the state government had made a provision to have 4% reservation for differently abled employees in all departments and corporations.
He alleged that he was not being given the benefit of promotion to the post of manager, while according to the Rights of Persons with Disability Act, he was eligible for promotion under 4% reservation quota.
The petitioner urged the court to direct the respondent to promote him to the post of manager by giving him the benefit of disability.
