Mohaniya to be quizzed in second case after bail, will not be arrested

NEW DELHI: AAP’s Sangam Vihar MLA, Dinesh Mohaniya, will be questioned in connection with the second FIR that was registered against him at the Govindpuri police station on Friday.

Mohaniya had been first detained in a dramatic fashion on Saturday before being arrested and sent to jail till Monday.

The Delhi Police on Sunday justified Mohaniya’s arrest in the first FIR, saying the AAP legislator had been “evading” questioning and had not joined the probe.

The second FIR was registered on a complaint filed by a senior citizen, Rakesh Kumar, who accused Mohaniya of slapping and pushing him to the ground after he complained about the lack of amenities in his locality. A case was registered under sections 323 (voluntarily causing hurt) and 341 (wrongful restraint) of the Indian Penal Code, said police.

Mandeep Singh Randhawa, DCP (southeast), said that a notice will be served to Mohaniya, asking him to be available for questioning in the second FIR, after his release from jail on bail.

On being asked if they have enough evidence to prove charges against the AAP MLA, Randhawa said, “At this moment, we don’t have any video footage of the slapping incident but we have independent witnesses. The statements of two-three witnesses have already been recorded.”

Police said Mohaniya’s questioning is required as they need to record his side of the story on the allegations made by the 60-year-old complainant. Police sources said Mohaniya will not be arrested in the second case since all the charges in the FIR were bailable.
