DSP questions SC jurisdiction
Gujarat Police DSP questions SC’s jurisdiction to hear the state Govt’s petition challenging the anticipatory bail granted to him by an Ahmedabad court in the fake encounter case, reports Satya Prakash.
Gujarat Police DSP (CID) NK Amin on Thursday questioned the Supreme Court’s jurisdiction to hear the state government’s petition challenging the anticipatory bail granted to him by an Ahmedabad court in the fake encounter case.
In his reply to the court’s notice on the state’s appeal, Amin said the Supreme Court could not have given permission to the Gujarat government to file a special leave petition as there was an alternative remedy available in law, which is to approach the high court.
He contested the state’s submission that he was needed for custodial interrogation in the case, saying he had already been interrogated on several occasions by the investigating team.
Amin vehemently objected to the victim’s family’s allegation that Muslim accused in the state were not getting bail in post-Godhra Gujarat.
