An apex court bench of Justice RM Lodha and Justice Anil R Dave issued notice saying that it was limited to the question as to why Banerjee should not be made a party to the petition.

However, the court clarified that the notice should not be construed that the allegations made against Banerjee had credibility or otherwise.

Petitioner Kunal Saha has challenged a Calcutta high court decision dropping Banerjee's name as a respondent in the petition.
