Swamy, who is the petitioner in the 2G case in the apex court, wrote to Prime Minister Manmohan Singh requesting him to direct the AG to recuse from the case in "public interest" or else he warned that he would seek the apex court's intervention for the purpose.

He claimed that Vahanvati was a party in the decision making by former Minister Raja in 2007 as he gave an opinion to him contrary to that of the then Law Minister.
