Treat unborn child at par with minor child: Delhi HC

In a significant ruling, the Delhi High Court (HC) said that an unborn child can be treated at par with a minor child, in matters of accident compensation claim.

In a significant ruling, the Delhi High Court (HC) said that an unborn child can be treated at par with a minor child, in matters of accident compensation claim.

The court said this while directing Reliance General Insurance company to pay compensation of Rs 2.5 lakh to a man who lost his pregnant wife in a road accident.

Justice J R Midha allowed an appeal filed by one Prakash, seeking compensation for his unborn child as his plea was ignored by the Motor Accident Claim Tribunal(MACT).

“The appeal is allowed and the compensation of Rs 2.5 lakh along with interest.. is awarded to Prakash towards the death of seven month-old foetus on June 17, 2008,” the Court said in a judgement.

The MACT has already awarded Rs 6.11 lakh to Prakash for the accident in which his wife died with a seven-month-old foetus in her womb.
