It was also alleged that they were trying to oust her from their house so as to end her share in the property of her husband.
This order was passed by a division bench comprising Justice RC Deepak and Justice MK Mittal after hearing counsels of both sides.
Appearing on behalf of the petitioner, senior advocate Satish Trivedi contended that the FIR was motivated on account of malice for pressurising the petitioners not to make any claim upon the self-earned property of Kishori Lal.
She also had the backing of one of a top police officer of the State who happens to be the family friend and had been helping her for some ulterior motive.
Manish Tiwari, counsel for the complainant opposed the petition on behalf of the complainant.
It may be recalled that Vandana Prasad was married to Anil Kumar, son of the petitioner Kishori Lal.
Later, Anil died due to some serious ailment.
Thereafter, Vandana lodged an FIR at the police station Tajganj, Agra on March 28, 2006 against her father-in-law and other family members under Section 498A, 406 of Indian Penal Code and 3/4 of Dowry Prohibition Act.
