THE ALLAHABAD High Court on Monday dismissed a writ petition filed by a Bahujan Samaj Party (BSP) MP from Azamgarh, Rama Kant Yadav, seeking quashing of an FIR against him and a stay on his arrest in connection with traffic obstruction in Azamgarh.

Rejecting the plea of the petitioner that he was falsely implicated in the case because of political rivalry as he belonged to the BSP and had defeated the Samajwadi Party (SP) candidate, the Court said, “Such a plea can always be raised by a politician who belongs to the opposite party, whenever he is involved in an offence.’’
Making these observations, a division bench comprising Justice Imtiyaz Murtaza and Justice Amar Saran declined to interfere with the FIR, as a cognizable offence was made out against the petitioner.
According to the FIR, on April 5 this year, Rama Kant Yadav, MP and his 200-250 supporters armed with guns collected at Pawai crossing in Azamgarh and obstructed the traffic movements which caused great inconvenience to the public.
A report was lodged by the police on April 6 under Section 143 (unlawful assembly) and 341 (wrongful restraint) of theIPC against Rama Kant Yadav and others at Pawai, police station of Azamgarh district.
The MP filed a petition before the High Court challenging the FIR and also requesting the court to stay the arrest of the petitioner. The court rejecting the MP’s argument of political vendetta and dismissed the writ petition.
Welcomed: The Samajwadi Adhivakta Sabha welcomed the appointment of Virendra Bhatia, Rajya Sabha MP and former advocate-general, as national president of the Samajwadi Adhvakta Sabha.
A meeting of lawyers, held under the presidentship of Vinay Pratap Singh Yadav, the state secretary of Sabha, welcomed the appointment of Bhatia. The meeting also congratulated the Chief Minister for appointing Bhatia as national president of the Sabha.
Speakers said that Bhatia had become popular among lawyers due to the fact that he got several welfare schemes of lawyers implemented by the State Government.
