CJM hauls up investigation officer

In the case of State Vs Lata Chaturvedi, under Sections 304, 506 of IPC was being investigated by Shivali Police station.

The viscera of the deceased was sent for investigation to the forensic laboratory to ascertain the cause of death. The investigating officer without acknowledging the investigation of viscera submitted the final report of the case on May 28, 2005. However, after getting report, which stated that death was caused due to poisoning, additional investigations were sought from the police.

In the process, the investigating officer converted the additional investigating from under Section 302 IPC to 304 IPC, whereas, no reason was mentioned for the change. Therefore, the court directed the police to take the accused under custody under Section 302 of IPC in the court on January 6, 2005.

Absconder arrested
AN ACCUSED absconding since June 18, 2005 after he was found guilty by the court, was taken into custody and sent to jail. He had come to attend the trial in another case pending against him under the NDPS Act in the court of ADJ (VIII) of Kanpur Dehat.

Aqil alias Khalil was chargesheeted under Sections 392, 411 and 25 of the IPC vide case number SST 37/2002, SST 470, 471, 472 and 473 of 2002 by the judge of anti-dacoity court of Kanpur Dehat.

Incidentaly, his trial is pending in the same court in another case of loot committed by him in year 2000 under police circle Akbarpur of Kanpur Dehat.

Aqil’s trial was completed in both the cases in 2002 and he was found guilty.

Only his sentence was to be pronounced, but he went missing since then.
However, his case file was at present with the high court, since the other two co-accused were sentenced to 10 years of imprisonment by the court and they approached the high court for relief in punishment, said court sources.

Directive to Chaubeypur police
CJM Harish Tripathi of Kanpur Dehat directed station officer Chaubeypur police station to come personally to court and explain the reason for delay in submission of FIR copy to court, for which directions were issued many times earlier.

According to court sources, on December 13, 2005 the court directed on the request of one Somnath, to file an FIR against Devsharan Tiwari and others.

However, on December 20 and 24, 2005 and January 2, 3 and 4, 2006 were also fixed for submission of FIR by the court, but the police failed to submit the FIR copy. Taking a serious note of negligence committed by the police, the court passed the order.
