DCF asks KDA to pay

DISTRICT CONSUMER Forum (DCF) asked the Kanpur Development Authority (KDA) to pay Rs 3.9 lakh with interest of 16 per cent from the date of deposit to complainant. Besides, it also asked to pay Rs 5,000 as compensation money too within two months of time.

DISTRICT CONSUMER Forum (DCF) asked the Kanpur Development Authority (KDA) to pay Rs 3.9 lakh with interest of 16 per cent from the date of deposit to complainant. Besides, it also asked to pay Rs 5,000 as compensation money too within two months of time.

The complainant Sheela Srivastva said in her petition that under the immediate allotment scheme of KDA, she applied for ground floor plot of HIG/HS-11 area measuring 297.28 square meter.

On November 11,2002 a draft worth Rs 1.5 lakh was deposited. Therefore, instead of allotting the same plot to her. KDA allotted another plot HS-12 to her after four month on March 8, 2003.

However, after her repeated request for the plot, for which allotment was sought nothing could be done by the KDA. Whereas, without any information, the said plots’ rates were increased from Rs 15.58 lakh to 17.47 lakh, she alleged.

On the demand of KDA, allottee deposited additional amount Rs 2.4 lakh in order to get the allotment of the same plot at later stage. But KDA did not change the allotment in favour of her. Therefore, complainant submitted the petition with DCF to seek justice. She demanded that allotted plot to her should be sold on the same rate as mentioned under the scheme at initial stage by KDA in the tune of Rs 15.58 lakh and also demanded compensation worth Rs 50,000.

However, KDA representative refuted all allegation leveled by petitioner and said that the amount was deposited for the plot number HS-12 and not for HS-11.
About another allegation of the increased price of plot from Rs 15.58 lakh to Rs 17.47 lakh, the KDA representative informed that this has been mentioned by allottee and not by the KDA.

However, taking note of all evidences presented with DCF. The three members committee stated that petitioner had applied for plot number HS-11. However, the price of the same was fixed by KDA worth Rs 17.47 lakh. Besides, it also observed that complainant has paid Rs 3.9 lakh against the allotment proceedings to KDA.

The DCF said that due to unfair means opted by KDA, the complainant was not allotted the actual plot, for which she had applied. This was a big mistake made by KDA. Therefore, it passed said order in favour of complainant.
