The Lucknow bench of the Allahabad High Court directed the Election Commission not to declare the poll result of Kairana Lok Sabha seat.
The Lucknow bench of the Allahabad High Court on Thursday directed the Election Commission not to declare the poll result of Kairana Lok Sabha seat in Muzaffarnagar district of the State pending disposal of a petition alleging irregularities in the elecitons.
A division bench comprising Justice UK Dhaon and Justice RK Sharma passed the order on a writ petition filed by BSP candidate from the seat Shanawaz Rana alleging large scale irregularities in the polling which was held on May 10.
The court granted three weeks time to the EC to file counter affidavit in the matter and also issued notices to the Rashtriya Lok Dal candidate and state minister Anuradha Chaudhary, the District Magistrate and the SSP of Muzaffarnagar.
Rana, in his petition alleged that Chaudhary had indulged in booth capturing at several places during polling.
He also alleged that despite several representations to the EC in this regard no action was taken and he was arrested by the District Administration in the afternoon on the polling day.
Rana's counsel was senior supreme court lawyer SC Maheswari, who is the Congress candidate from Kairana Lok Sabha seat.
