Forum asks Dynamic Ford to pay cost of car
THE DISTRICT Consumer Forum (DCF) directed the Ford India Limited to pay the cost of Ford Ikon worth Rs 5, 24,484 to the complainant within two month from February 27.

According to the DCF sources, a complaint was registered against the Ford India Limited and its local distributor, Dynamic Ford, by one Jagdish Lal Arora.
Arora purchased a Ford Ikon car from Dynamic Ford, Jareeb Chowki on March 25, 2003 with a warranty of 12 months by paying Rs 5,24,484 through finance process from the HDFC Bank. The car was insured and the road tax was paid from the date of purchase and was allotted the registration number UP-78 AM 3717.
However, the car developed snag on August 3, 2003 and it was sent for rectification to the Dynamic Ford workshop on August 4, 2003.
On August 18, 2003 during visit to the workshop, Arora observed that the car engine was being overhauled after breaking the safety seal and a mechanic informed him that the defect was of permanent nature and its life would be curtailed even after the repair. After knowing the fact about the engine, he requested for change of the car, but the company did not accept the same. So, he filed a case in the DCF against the company.
However, opposing the petition, the representative of car company said the car was not used according to warranty norms and the defect was due to careless driving. Therefore, change of car was not a valid demand.
However, the three-member Forum including DCF chairman AH Ansari stated that the car company failed to take permission from the complainant before opening the engine seal, which indicated that defect was originated from the manufacturing side. Taking a note of the all evidences, the DCF passed the order in favour of complainant.
