Sub-inspector DK Pandey registered an FIR with Mufassil police station at Siwan town under Sections 353 (assault or criminal force to deter public servant from discharge of his duty) and 506 (criminal intimidation) of Indian Penal Code against Shahabuddin.

Pandey alleged in the FIR that when he turned up to record the RJD leader's statement in the court in Siwan jail in connection with the recovery of stolen vehicles from his house at Pratappur during a police raid in April 2005, the MP threatened to beat him up once he was enlarged on bail.

"Bahut din se tum logon ki pitai nahin hui hai. Bail hone do peet ke rakh denge (you people have not been beaten up for a long time. Let me come out on bail and I will thrash you)," Pandey has alleged in the FIR.

Special court judge V B Gupta was not present in the court at that time, official sources said.
